Conservation Law Forum – June 23, 2015

The Conservation Law Forum is a roundtable discussion among attorneys with land trusts, state and regional agencies and firms to learn, discuss and help shape conservation law in California.

The Forum convenes three times per year to discuss current legal cases in California, to improve conservation practice in California, to consider and prioritize emerging legal and policy issues for conservation lands, and to review strategies and provide guidance for meeting these challenges.  It is open to attorneys with land trusts and public agencies and to others by invitation. MCLE Credits are available.

Topics will include:

  • Use of the word “material” in conservation easements:  wise or not?  Montana case and lessons learned
  • Balsam Mountain v. Commissioner—Conservation Easement Authorizing Limited Swaps Not Deductible Under § 170(h).  Follow-up to March presentation: subsequent cases and definition of “floating homesite”.
  • Conflicts of Interest/insider transactions.  Basics re written policies and a sophisticated example or two
  • New LTA accreditation requirements. Are there really fewer requirements?
  • Legislative, etc. update
  • Closing Round Robin:  Participants are encouraged to raise topics and ask questions.  We’re particularly interested in those relating to conflict of interest/policies or conservation easement enforcement
